AVN.- The Electoral Chamber of Venezuela's Supreme Court of Justice (TSJ, Spanish acronym) declared this Monday inadmissible the appeal filed by the General Prosecutor Luisa Ortega Diaz, in which she requested to annul the Constituent process.
According to information published by the TSJ in its page, the said appeal attacks the Executive and the Electoral branches, which requires to be addressed by different jurisdictions.
"Hence, in view of this doctrine, no claims for nullity of actions emanating from different bodies –whose knowledge is incumbent on different jurisdictions, in this specific case, the Constitutional Chamber and the Electoral Chamber– can be accumulated in the same libel," according to the ruling, outlined in a press release.
This appeal for annulment is the second Prosecutor's action against the National Constituent Assembly, since she requested last June 1 the clarification of sentence 378 in which the highest court considered that it is not necessary or constitutionally binding, a consultative referendum process for the convening of such constituent assembly.
This clarification was declared inadmissible due to lack of legitimacy of the Prosecutor, according to the constitutional powers of the Public Ministry.
